In the State of NJ, the following penalties apply according to BAC (Blood Alcohol Content) as well as the number of offenses.

1st Offense with a BAC of .08% - .10%: Fine of $250-$400; Jail Sentence of not more than 30 Days at the discretion of the court; 12-48 hours must be spent at an Intoxicated Driver Resource Center over the course of 2 Days; 3 Month License Suspension.

1st Offense with a BAC of .10% or over: Fine of $300-$500; Jail Sentence of not more than 30 Days at the discretion of the court; 12-48 hours must be spent at an Intoxicated Driver Resource Center over the course of 2 days; License Suspension of 7 Months to a maximum of 1 Year.

2nd Offense: Fine of $500-$1,000; Jail sentence of no less than 48 Hours; 2 Year License Suspension; 30 Days community service.

3rd Offense: Fine of $1,000; Jail sentence of no less than 180 Days in County Workhouse; 10 Year License Suspension.
